IF YOU MISSED YOUR GREEN CARD RENEWAL DEADLINE

IF YOU MISSED YOUR GREEN CARD RENEWAL DEADLINE

While your permanent resident status is permanent, your green card is not. It is usually issued for a period of 10 years. The validity limitation was initially introduced in attempt to deal with frequent fraudulent green cards use.

Within 6 months before the green card expiration, a permanent resident has an option to renew it by filing Form I-90 with USCIS. If the permanent resident missed the deadline and the green card expired, there is no fine, fee or special liability. The green card holder will not lose its permanent resident status just because the green card is expired. However, the green card holder might have problems with traveling, getting a job, buying real estate, obtaining driver’s license. If the green card is expired – there will be no proof for third parties to verify your permanent resident status in the U.S.

The most serious issues you might experience if you travel with an expired green card when coming back to the U.S. CBP authorities will conduct additional security and immigration checks which might result in denial of your entrance to the U.S. (rare case).  If CBP allows you to enter you will need to pay $575. If you are outside of the U.S. with an expired green card and have time, you may want to file Form I-131A with the local U.S. Consulate. If you urgently need to travel and realized that you green card is expired, you need to consider obtaining a stamp I-551 in your passport. This can be done by scheduling an Infopass Appointment with your local USCIS office. It is strongly recommended to consult an attorney if you travel overseas.
