On June 26, 2019 USCIS published another quarterly report on I-526 / I-829 processing times. The news are not encouraging – the processing time for I-526 has increased by 62% in January-March 2019.

THE 90-DAY RULE – FRAUD AND WILLFUL MISREPRESENTATION

To find a person inadmissible for fraud or willful misrepresentation, there must be at least some evidence that would permit a reasonable person to find that the person used fraud or that he or she willfully misrepresented a material fact in an attempt to obtain a visa, other documentation, admission into the United States, or any other immigration benefit.

In addition, the evidence must show that the person made the misrepresentation to an authorized official of the U.S. government, whether in person, in writing, or through other means. Examples of evidence an officer may consider include oral or written testimony, or any other documentation containing false information.

EB-5 AND REDEMPTION AGREEMENTS

 

Foreign nationals may seek an immigrant visa based on their investment in a new commercial enterprise in the United States if they meet certain related job creation requirements (EB-5, investors visa, etc.)

To make a qualifying investment, the immigrant investor must contribute the minimum investment amount in a manner that does not constitute a debt arrangement.

Relevant precedent provides that a redemption agreement is a debt arrangement if the petitioner enters into the agreement knowing that he or she has a willing buyer at a certain time and for a certain price. Recently, two federal courts have addressed the issue of redemption agreements in the context of options exercisable by the new commercial enterprise.

This update to Volume 6 of the Policy Manual clarifies which redemption agreements are considered debt arrangements. This policy guidance is controlling and supersedes any prior
guidance on the topic.

MARRIAGE AND LIVING IN MARITAL UNION REQUIREMENTS FOR NATURALIZATION

U.S. Citizenship and Immigration Services is updating policy guidance in the USCIS Policy Manual to clarify the marriage and living in marital union requirements under section 319(a) of the Immigration and Nationality Act (INA).

The  statutory provisions require the applicant spouse to have been married and “living in marital union” (living together) with his or her U.S. citizen spouse for at least 3 years immediately before he or she filed the naturalization application. However, the living is required ONLY until the time of filing for naturalization.

PRODUCER BRUCKHEIMER SELLS HIS BRENTWOOD HOUSE

With a significant overall price reduction, and after a long stretch on the market, produced Jerry Bruckheimer has seen his Brentwood contemporary into contract. The property had been most recently listed with an asking price of $11.9 million, and had been initially listed in 2015 for $14.5 million. Bruckheimer owned the property home for thirty years, having purchased it in 1985 for $1.9 million.

 

Known as the Siskin House, and constructed in 1965, the formal concrete, glass and wood design measures 9,030 square feet with seven bedrooms and seven baths, including a guest house.

 

The main residence features vaulted ceilings, a library, kitchen with breakfast nook, and media room. The master suite is located in its own wing of the home.

 

The design and layout is heavily Japanese-influenced; the clean lines throughout, the private garden of the master suite merging natural landscape and interior, the compartmentalized, illuminated open spaces, the glass paneled halls and the frosted glass panels of the main entryway echo tropes of Japanese dwellings.

 

The meditative and detached feel of the home is balanced with polished hardwood floors, and the hardwood ceilings of the living room. The Japanese-inspired chandelier in the dining room stands out beautifully against all the glass and space. Water features and fireplaces add a little soothingly overt kinetic energy, and coherence to the vision.

 

Producer Jerry Bruckheimer’s ‘Pirates of the Caribbean’ franchise films have grossed $3.7 billion. The newest film of the series, ‘Dead Men Tell No Tales,’ will be opening in the spring.
